Who are we and who is responsible for your personal data?

Simonds Group Limited (ACN 143 841 801) (we, us, our, or Simonds) is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth) (Privacy Act) and related privacy laws, regulations and codes.

The purpose of this Privacy Policy is to provide you with an understanding of how we collect, use, disclose and otherwise handle your personal information, along with the steps we take to protect it.

What personal data do we collect about you and for what purposes?

Personal information means information (including an opinion) whether true or not and whether recorded in a material form or not, about an individual who is identified or may reasonably be identifiable from that information.

The types of personal information that we collect will depend upon what dealings you may have with us. We may collect and hold personal information about you in the following ways, including when:

  • you purchase, or express an interest to purchase, a Simonds home. For example, when entering into a sale and purchase agreement, or when seeking information about a Simonds home;

  • you lease, or express an interest to lease, a display home. For example, when negotiating, entering or applying to enter into a lease with Simonds;

  • we supply goods and services to you. For example, when establishing records and systems to enable payment for goods and services;

  • you enter a Simonds office, gallery, display home or building site. For example, when maintaining visitor registrations for a Simonds display gallery, or capturing video or images through surveillance systems in a Simonds office or gallery;

  • you register or subscribe to our marketing programs, mailing lists, promotions, newsletters or competitions;

  • you use our websites, social media and other online services;

  • you logon to wireless facilities provided in our offices or galleries;

  • you otherwise come into contact with us, for example to provide a testimonial; or

  • you are provided with credit and loan services by one of our recommend mortgage brokers.

We only collect personal information which is reasonably necessary for our dealings with you. The types of personal information collected may include:

  • your name, gender, address and contact details;

  • your date of birth;

  • photos or video images of you;

  • information about your financial position;

  • information about you that is required or authorised by law;

  • your tax file number;

  • your nominated bank account details; and

  • your opinion about our products, services or staff.

Whenever it is reasonable and practical to do so, we collect personal information directly from you. In some circumstances, personal information may be provided to Simonds by other parties such as a member of your family, your agent or our authorised agents and subcontractors.

You may provide us with the personal information of a third-party (e.g., information about guarantors). If you would like to provide us with the personal information of a third-party, you agree that you have obtained the necessary consents for us to collect that personal information and to contact those individuals as reasonably required.

If you do not provide personal information that we request in connection with our business functions and activities, we may not be able to provide you with some or all of our products or services.

How we use your personal information

General

In general, we may collect, hold and use your personal information including to:

  • provide goods or services to you at your request;

  • communicate with you, including following up on any enquiries you make through our various channels;

  • manage, improve and enhance our goods and services, including analysing customer feedback;

  • help us to assess your financial position;

  • provide ongoing information and marketing about goods and services, where you have consented to receive such information;

  • manage security and safety requirements in our offices, display homes, galleries and building sites;

  • general administration and business purposes;

  • comply with all relevant laws and regulations;

  • recruit and employ; or

  • fulfill our obligations to our employees.

Job applicants and contractors

We will collect your personal information if you submit a job application or register an interest in employment with us or any of our related companies, or if you wish to become a contractor for us. In such cases, we may collect information, including:

  • your name, contact details, email address;

  • your CV and other related documentation or certification;

  • your skills, experience and educational and trade qualifications;

  • any references; and

  • any other information you provide to us.

We may collect personal information from third parties such as recruitment agencies, your referees, former employers and educational institutions.

If you are applying for a job or a contractor role with us, we may collect and manage your personal information, including:

  • to assess your application, including conducting background checks and interviews;

  • to facilitate any communication between you and us; and

  • internal record keeping purposes.

You may provide us with other people’s personal information as part of your application such as information about your referees. You agree that you have obtained the necessary consents for us to collect that personal information, and to contact those individuals for any of the above purposes in connection with your application.

If your application is unsuccessful, we may retain any personal information you provide for a limited period in case another opportunity becomes available.

Shareholder's or potential shareholder's personal information

If you are a shareholder or potential shareholder of Simonds, we will collect your personal information when you go through the investment process. For example, if you purchase or apply to purchase any shares issued by Simonds.

The personal information we may collect from you if you are a shareholder or potential shareholder of Simonds, includes:

  • your name, date of birth, address, contact details or photo;

  • your bank account details;

  • details of the shares you hold and your shareholder reference number; and

  • any other information you provide to us.

In addition to the above, we may manage your personal information for the following purposes, including:

  • managing your shareholding in Simonds and keeping your records on the shareholder register up-to-date;

  • facilitating shareholder-related communications or provide you with any shareholder materials such as annual reports or notices of annual general meetings;

  • paying dividends;

  • responding to any queries you may have; or

  • complying with our legal obligations such as record keeping requirement.

Marketing

We may send you direct marketing communications and information about our products and services that we consider may be of interest to you. These communications may be sent in various forms, including mail, telephone calls, SMS, fax and email, in accordance with applicable marketing laws.

You consent to us sending you direct marketing communications. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so. If you would like to opt out to receiving these communications, please refer to the ‘Your rights over your personal data’ section of this policy.

We use third party vendors to advertise online and third-party affiliations to run advertising on websites and online platforms. Third party vendors, including Instagram, show our ads on sites across the internet by using cookies to serve ads based on someone’s past visits to our websites. This enables us and network advertisers to target advertisements to you for products and services in which you might be interested. We may provide these advertisers with information, including personal information, about you. Where permitted by applicable law, we can use third party vendor remarketing services, including Google’s ‘Customer Match’, Meta’s ‘Custom Audience’, Meta Ads, Google Ads, Google Display Network, Pinterest Ads, TikTok Ads, and Reddit Ads to display ads. This means if you have provided us with your contact details, we may upload these to third party vendors who perform remarketing services on our behalf, so that we can better target ads and content to you and others with similar interests on other websites or media.  We may also work with other ad networks and marketing platforms that enable us and other participants to target ads. If you would like to opt out of receiving advertisement from third-party vendor and affiliates, you must do so via that third parties opt out facilities members.

Website and Cookies

We use Google Analytics and cookies to help us make our website more useful and personal for you. A cookie is a small data file that may be placed on the computer of a web user (usually in the browser software folder) during a visit to our website. For example, our cookies will remember your chosen state, so that when you visit our website the packages and designs are available in your state.

We sometimes also use performance tracking technology (such as conversion tags and pixels) to help track user behaviour on our websites. Such user traffic and performance tracking data is non-personally identifying and is collected on an aggregate level to report statistics to assist us in improving the quality and relevancy of our services. For example, when you read, browse or download information from our website, we or our internet service provider may also collect information such as the date, time and duration of your visit, for purposes including statistical, reporting, website administration, maintenance and improvement.

If you do not wish to receive any cookies on our websites, you should set your browser to refuse cookies, however, this may mean that you may have limited access to use our websites.

Our websites may contain links to other websites operated by third parties. We make no representation or warranties in relation to the privacy practices of any third-party website and we are not responsible for the privacy policies or the content of any third party website. Third party websites are responsible for informing you about their own privacy practices.

Wi-fi services

When you register to use Wi-Fi services provided by us, we will collect your personal information in relation to your use of our Wi-Fi services, and for any other purposes we notify you of at the time of collection.

Social media and review platforms

We may engage with customers or prospective customers through social media channels such as Instagram and Tiktok. Occasionally we may use this posted and uploaded media data for marketing materials and promotions and as such where possible, will endeavour to notify you before use.

In addition to the above, we aggregate commentary and reviews that have been uploaded to our website or posted publicly and willingly by users on their review platforms for marketing materials and promotions and as such, where possible, will endeavour to notify the owner before use. The use of this information sent via these review platforms is governed strictly by each social media platform’s security and privacy regulations.

Who do we share your personal data with?

Depending on the circumstances of your engagement with us, we may disclose your personal information to our related entities within the Simonds Group and third parties that provide products and services to us or through us, or to other third parties.

We may also disclose your personal information to third parties in certain circumstances, including:

  • our agents, contractors and service providers who assist in the operation of our business or who provide a customer service. For example, a third party which helps maintain our computer systems, sends out mail on our behalf or deliver our products and services, or our external share registry, Boardroom Pty Ltd;

  • third party lenders, valuers, mortgage brokers, insurers and professional service providers and advisors who perform functions on our behalf, such as financial advisors and lawyers;

  • lenders, valuers, insurers, brokers, auditors, business consultants and IT service providers;

  • the Australian Securities Exchange (ASX), the Australian Securities and Investments Commission (ASIC) and other government agencies as required by law;

  • any other party that you authorise us to disclose your personal information to; or

  • relevant parties in situations when we are required by law to provide the information.

We limit the personal information we disclose to external parties to only what is required for such third parties to perform their services for us or you, or what is required by law. We require these third parties to comply with all relevant privacy laws and regulations governing how your personal information may be used and stored. We do not disclose personal information to third parties unless:

·         we have your permission to collect, use, store and process your personal information as set out in this privacy policy;

·         the disclosure is permitted in accordance with a relevant law or regulation;

·         the party to whom the disclosure is made controls, is controlled by, or is under common control with Simonds Group;

·         the personal information to be disclosed is already available in the public domain;

·         the disclosure is for warranty purposes, meaning we will pass on the details necessary for a customer to be covered by individual manufacturer warranties for some of the appliances we install in their home;

·         the disclosure is related to the sale or other disposition of all or part of our business or assets; or

·         the disclosure is required in the ordinary course of operating our business, such as data processing.

We do not sell personal information to third parties outside Simonds Group.

Overseas disclosure

From time to time, your personal information may be disclosed, transferred, stored, processed or used overseas by us, or by third party service providers, to allow the external parties to perform their services for us or our related companies. This includes to organisations located in the United States, China, Philippines, Singapore, New Zealand and Vietnam. We will only disclose personal information overseas when it is necessary for the services provided by these external parties.

This includes where:

·         we outsource certain activities overseas; and

·         transactions, services or products that have an overseas connection, for example, our computer systems such as servers.

User Guidelines

When you post and interact on our platforms, please keep in mind that the following will not be tolerated:

  • trolling, coordinated group attacks, spam or bot accounts, the posting of unrelated content, promotional material or links to third party sites;

  • commentary that is discriminatory, abusive, threatening or otherwise obscene (including offensive language);

  • personal attacks or comments that reveal private details of employees, contractors or customers’ or makes unproven or unsupported accusations against individuals or organisations;

  • commentary promoting personal, professional or political interests;

  • any infringement of intellectual property rights;

  • unlawful content, including those prohibited by court or tribunal order or that violate privacy laws; or

  • comments that are misleading, deceptive or defamatory.

In instances where users don’t abide by these guidelines, we reserve the right to:

  • delete or hide comments at our discretion and block any offenders.

  • turn off the commenting capabilities on the affected post/s; and/or

  • request the removal of employee names from a customer’s review.

How we secure & protect your information?

We take steps to protect the personal information that we hold from unauthorised access, modification or disclosure, misuse, interference and loss. We have implemented technical and organisation security measures such as physical security measures over our physical premises, and a range of computer and network security measures (such as systems access, firewalls, data encryption) over our electronic systems. Our employees and third-party service providers are required to maintain the confidentiality of any personal information held by us and as required by law.

Data transmission over the internet cannot be guaranteed to be secure from intrusion.

Banking information

We may collect your banking information in circumstances where we are required to pay or receive money from you. This may include circumstances where you have purchased a Simonds display home subject to a lease between you and Simonds, and Simonds is required to pay rent to your nominated bank account under the terms of that lease.

The banking information that we collect and hold in an electronic format includes bank account names, bank account numbers and bank state branch (BSB) numbers.

We may use or disclose your banking credit information to:

·         perform general management activities, including to verify your identity with the issuer or official record holder of your identity documents via third party systems;

·         pay and receipt funds;

·         protect, enforce or defend the legal rights of any Simonds Group company;

·         comply with law or any legal process; and

·         engage third parties to assist us with any of the above.

We do not use your banking information to generate direct marketing lists.

How long will we keep your personal data?

Our retention periods for personal data are based on business and legal requirements. We retain personal data for as long as is required for processing purpose(s) for which the information was collected, and any other permissible purpose. For example, we may retain a copy of your building contract and correspondence until the statutory time limit for claims arising from that building contract has expired, or to comply with regulatory requirements regarding the retention of such data. When personal data is no longer required, we either securely destroy it, or irreversibly anonymise the data (and we may further retain and use the anonymised information).

How to access, correct and delete your personal information

You may request access to, or correction of, any personal information that we hold about you. To access or correct your personal information, you should write to our Privacy Officer using the contact details below. We must be satisfied that any request is made by you and may require evidence to verify your identity.

If you request access to records which are not current or your request is otherwise complex, it may take longer for us to locate those records, and we may charge you a reasonable administrative fee for the cost of providing such access.  If there is a charge, we will provide an estimate of how much this service will cost and will request agreement from you to these costs before proceeding.

In normal circumstances, we will provide you with access to your personal information and will correct it within a reasonable period. However, in some circumstances, there may be legal, regulatory or administrative reasons to deny the requested access or correction, for example, the Telecommunications Interception and Access Act 1979 (Cth) may require us to hold some of your personal information for a period of time. If access or correction is denied, we will provide you with the reasons for doing so

It is important that you notify us of any changes to your personal information (such as a change of address) so that the record we hold about you can be kept up to date. Please contact us if any of your details change.

 

Your rights over your personal data

You may opt-out of receiving marketing communications from us at any time by contacting us via the below details or by using the opt-out facilities provided in the marketing communications. We will then ensure that your name is removed from the mailing list within a reasonable period.

Dispute resolution and eligible data breaches

You may request further information about the way we manage your personal information or lodge a complaint if you believe that we have breached your privacy, by contacting our Privacy Officer using the contact details below.

We will deal with any complaint by investigating it and providing a response to you within a reasonable period, if we have all necessary information and have completed any investigation required. In some cases, we may need to ask you to put your complaint in writing so that we are sure that we understand it and may also need to ask you for further information or to verify your identity. We will treat your complaint confidentially and respond to you within a reasonable time, usually in writing.

If an eligible data breach has been reported by you and is confirmed, and as soon as practicable, we will provide a statement to each of the individuals whose data was breached or who are at risk, including details of the breach and recommendations of the steps individuals should take. A copy of the statement will also be provided to the Office of the Australian Information Commissioner (OAIC).
